Sale Terms And Conditions

In Using This Website, You Are Deemed To Have Read And Agreed To The Following Terms And Conditions.

1. All items for sale by Australian Wine Archives Pty Ltd (AWA) are sold in compliance of the Australian Capital Territory Liquor Act 2010. – AWA Liquor Licence number 14005239.
2. Under the ACT Liquor Act 2010, it is illegal to sell or supply to, or obtain alcohol on behalf of any persons under the age of 18 years.  You confirm that you are of legal drinking age.
3. Purchases are not considered as final until advised by AWA and AWA has received cleared funds in full.  Title for goods will not pass to the buyer until the funds are cleared.
4. AWA reserves the right to cancel any order at any time for any reason.  Where cleared funds have been made against any cancelled order, AWA will refund those funds paid.
5. All effort will be made to provide goods as stated in this website, however demand may limit availability and availability is subject to change without notice.
6. All quoted prices are in Australian dollars and payments are to be made in Australian dollars AU$.
7. AWA reserves the right to change or vary any information contained within this website.
8. AWA will endeavour to keep pricing up to date.  In the event of a pricing error or change, you will be notified.
9. You should make your selections carefully.  We will not refund wines because you have changed your mind or made a mistake.  It is your responsibility to choose carefully and review your selections on receipt of our invoice (prior to payment).
10. In the event of extreme (heat) temperatures, AWA will not ship wine.  Therefore, during extreme (heat), delays should be expected with wine deliveries.
11. All orders will be processed as quickly as possible, however, due to the reliance on – staff, freight companies, weather, availability, holidays etc, no guarantee of delivery time/date can be provided.  A broad time frame of up to 10 working days (Australia only) should be expected.
12. Our prices are our prices – AWA will not make any deduction for Australian WET or GST taxes.    In the event that goods are shipped overseas, all local taxes and duties are the responsibility of the purchaser.
13. Incorrect orders (our error only) should be reported to us within 24 hours of delivery.  You can notify us by telephone or e-mail to organize replacement or refund.  Pick-up of incorrect orders will be organized by us.
14. If items are broken when received (where we have organized freight and insurance), you should make note of this before signing for your delivery.  You should report these breakages to us within 24 hours of delivery by telephone or e-mail.  If you do not note the breakage on your delivery docket, we must assume that the wine was received in good order.
15. Information held on this website is for your personal use only.  It should not be copied or reproduced, modified or changed, nor distributed for any reason other than for your own personal/non commercial use.
16. If in the event of a breach of these terms and conditions by you, and AWA subsequently incurs any loss or damage or unforeseen costs, you agree to pay AWA for the cost of any and all of these losses, damages or costs.
